Generally, the Statue of Frauds requires “sufficient” writing for a contract to be valid for certain types of contracts. A common acronym is MYLEGS, 1) Marriage, 2) one Year, 3), Land, 4) Execution (probate), 5) Goods (over $500), and 6) Surety (a 3rd-party guarantee). At common law, contracts regarding “Marriage” were as they sound, a financial arrangement with marriage as the consideration and the daughter as the exchange. Today, the “Marriage” requirement under MYLEGS typically relates to prenups (or antenuptial agreements), and separation agreements. Just like everything contained in the MYLEGS requirements, there is a major exception.
