Week 1 Discussion 1: Laws That Impact the Staffing Environment
These sources, from the week’s studies and linked in the Resources, highlight a number of laws, many of which have an impact on the hiring process:
Labor Laws and Issues.
Summary of the Major Laws of the Department of Labor.
Media: Employment and Labor Law Timeline. (Please see attachement)
Select one law, executive order, or administrative ruling from the charts provided. (You may NOT use Title VII of the Civil Rights Act of 1964—its guidelines are simply too broad for this discussion)
Use at least three library or professional sources about the selected law to develop the following:
Describe the essentials of the law you selected. (FMLA is the law I selected)
Give an analysis of how the law impacts the hiring and recruiting process or the promotion process of an organization.
Offer at least three suggestions about how an organization could develop a plan to deal effectively with the requirements of this law.
In your response, be sure to cite, discuss, and reference the readings from this week in a way that clearly demonstrates that you have read and reflected on each as they relate to “becoming a doctoral.” Follow Evidence and APALinks to an external site. style and formatting guidelines.
Note: Do not approach these discussions as simply completing another activity to be accomplished as soon as possible. As a budding scholar, your task is to fill your personal knowledge gaps. The ensuing scholarly discussion will further enhance that learning with the exchange of ideas and exposure to additional concepts. Be sure your response demonstrates the critical thinking skills of analysis, evaluation, and synthesis.
Week 1 Discussion 2: Jurisdictions for Employment Laws
Today, the list of laws, court rulings, and executive and administrative orders that impact the work of HR professionals can often seem overwhelming. Despite the ever-increasing number of employment laws, there is a constant call for more rules and regulations. A good example of this phenomenon is the issue of minimum wage. The 2018 federal minimum wage is $7.25 in the District of Columbia, but many states currently have a minimum wage above $7.25 (some are as high as $11.50). In addition, there are cities with their own minimum wage (currently, San Francisco tops at $15.00). There are many other examples of employment regulations that vary per different jurisdictions, such as requiring contractors to hire a minimum percentage of minorities for state construction projects and placing requirements on access to work sites for disabled workers. While there are certainly many good reasons for these requirements, they can create a real issue for HR professionals, especially for those with multiple locations across state and city lines. Having different requirements in different locations makes it difficult to develop consistent policies and training programs.
For this discussion, based on research and analysis from at least two sources, what are some specific issues that an HR professional may encounter when regulations differ across state and city lines?
Describe at least two HR issues impacted by the existence of different laws in different jurisdictions, such as state and city regulations.
What suggestions would you offer government regulators to address these issues?
Describe how an organization can develop a plan to deal with these issues.
