2. Pennington Village Hall, in south Wales, was hosting a choir based music recital one lunchtime. There was a sudden cracking noise which came from the roof – a concrete support fell onto the stage, physically injuring a number of people. The builders of the Village Hall have admitted liability in negligence because of mistakes made in the design of the concrete support. James Smith was in the direct path of the falling concrete support; he managed to roll out of the way just in time but was very shaken by the experience. Mark Jones was standing next to him but was not so lucky, he was trapped, unconscious, under a great deal of debris. Mark’s sister Elaine witnessed the accident and was convinced, for the next two hours, that Mark had died. Mark was then pulled out of the debris alive, but with no memory of what happened to him that day. The concert was being audio live streamed on FaceBit. Mark’s wife Tracy was listening to the concert from her home in Scotland. Tracy was convinced she had heard Mark’s screaming and believed he was fatally injured. Tracy managed to catch a plane to Cardiff and arrived at the hall before Mark was rescued. The choir’s conductor Rachel was not physically injured but was distraught at these events – two choir members were killed right in front of her. Jane, a paramedic worked tirelessly to assist the casualties but became overwhelmed by what she had witnessed, and subsequently took three months off work.
James, Tracy, Rachel and Jane have all been diagnosed with PTSD. Advise them how the law would approach a claim for psychiatric injury using the tort of negligence.
